Terms of Service

Current operating status. This Service is an independent, experimental project operated by a private individual resident in Italy, on an occasional basis, for personal and testing purposes. It is not currently operated through a registered Italian business (no Partita IVA has been opened). In line with Italian tax law (Art. 67, comma 1, lett. i, TUIR — "redditi diversi" from non-habitual commercial activity), any income the Service may generate — for example through advertising — will be declared by the operator through their personal tax return for as long as the activity remains genuinely occasional. Should the Service's activity or revenue grow to a point where it no longer qualifies as occasional under Italian law, the operator will register a business (Partita IVA) accordingly. This status may therefore change over time as the project evolves.

These Terms of Service ("Terms") govern your use of background-remover.it (the "Service"), operated by a private individual based in Italy ("we", "us", "the operator") on the basis described above. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service does

The Service is a free tool that removes the background from images entirely within your own browser, using client-side AI processing (WebAssembly). Images you process are never uploaded, transmitted, or stored on our servers or by us in any form. We have no technical ability to view, access, retain, or moderate any image you process, because it never reaches us.

2. Eligibility

You must be of legal age in your jurisdiction to accept these Terms on your own behalf, or have the permission of a parent or legal guardian. The Service is not directed at children.

3. Your responsibility for content

You are solely and entirely responsible for every image you process through the Service, and for how you obtain, use, and distribute the result. By using the Service, you represent and warrant that:

you own the image, or you have all necessary rights, licenses, and permissions to use, edit, and process it;
the image does not infringe any third party's copyright, trademark, privacy, publicity, or other rights;
the image does not depict, and its processing does not facilitate, any illegal act — including but not limited to content involving minors in any sexual or exploitative context, non-consensual intimate imagery, content that violates any person's likeness rights without consent, or content otherwise prohibited by applicable law;
your use of the Service and of any resulting file complies with all applicable local, national, and international laws.

Because the Service processes images entirely on your own device and never transmits them to us, we have no way to review, screen, or become aware of the content you process. Responsibility for the legality, ownership, and appropriateness of any image — before, during, and after processing — rests exclusively with you, the user. We are not a publisher, host, or distributor of any image processed through the Service, and we do not review, endorse, or take responsibility for user content in any way.

4. Prohibited use

You may not use the Service to process content that is illegal, that infringes third-party rights, or to attempt to reverse-engineer, disrupt, overload, or misuse the Service, its underlying libraries, or its infrastructure.

5. No warranty

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that background removal results will be accurate, complete, or suitable for any specific use, or that the Service will be uninterrupted, error-free, or available at all times. As an occasional, non-commercial project, the Service may be modified, interrupted, or discontinued without notice.

6. Limitation of liability

To the maximum extent permitted by applicable law, the operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use of, or inability to use, the Service — including any liability arising from images you process, upload sources, or downstream use of results.

Because the Service is provided free of charge, and to the extent permitted by applicable law, our total aggregate liability for any claim arising from the Service is limited to the amount you paid us to use it (i.e., zero). Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for willful misconduct or gross negligence, or in any other case where such limitation would not be permitted under mandatory Italian or EU law.

7. Indemnification

You agree to indemnify and hold harmless the operator from any claim, damage, liability, cost, or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any right of a third party, including in relation to any image you process.

8. Third-party components

The Service relies on third-party, open-source software to perform background removal, including the @imgly/background-removal library (licensed under AGPL-3.0) and its underlying AI model, loaded from a public CDN. It may also load fonts from Google Fonts. These components are subject to their own license terms, available at their respective sources. The Service displays third-party advertisements via Google AdSense, subject to Google's own terms.

9. Intellectual property

The design, text, and original code of this site (excluding third-party libraries referenced above) belong to the operator of the Service. You retain all rights to the images you process; we claim no ownership over your content, which we never receive in the first place.

10. Advertising

The Service displays third-party advertisements (via Google AdSense) to support its free operation. We do not control the content of ads served by third-party networks and are not responsible for the products, services, or claims made in them.

11. Changes to the Service or these Terms

We may modify, suspend, or discontinue the Service at any time, and may update these Terms from time to time — including to reflect a future change in operating status (for example, if the operator registers a Partita IVA as the project grows). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law and jurisdiction

These Terms are governed by Italian law, without prejudice to any mandatory consumer-protection provisions of the country where you, as a consumer, habitually reside, which may still apply. Any dispute not resolved informally shall be subject to the exclusive jurisdiction of the Italian courts having territorial jurisdiction over the operator's place of residence, save for mandatory consumer venue rules that cannot be waived.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
